I have just been informed by the Los Gatos Small Claims Court that Commissioner Heath of that court has scheduled a hearing on the third party claim of Nathaniel Berkowitz, to be held on Friday, December 29, 1995.

I am now on my way to Los Gatos to obtain a copy of Commissioner Heath's order.

I hope that, in accordance with our conversation of Tuesday, December 19, 1995, you will suspend the return of the funds, pending the outcome of this hearing.

For your information, this hearing was arranged through the intervention of Judge Robert J. Stafford, a judge of the Santa Clara County Municipal Court, who is the presiding judge in small claims matters.
