Interesting question: Can he be tried for treason? As I understand treason, he is not guilty and cannot be tried. The Taliban was fighting against the Northern Alliance, not against America. In no way can fighting against the Northern Alliance be considered treason.
There is a lot of loose talk about trying him, convicting him and putting him to death. However, where is the evidence, where are the witnesses and under what provision of the United States Code can he be charged?
