Order to Show Cause in Sloan vs. Marinello, 2004-7739 has been signed

I have just received word from Judge Horowitz's chambers that the Order to Show Cause has been signed in Sloan vs. Marinello, Index No. 2004-7739

The order was signed today, November 16, 2004. It schedules a hearing to be held on November 30, 2004 at 9:00 AM in Courtroom 6 at 255 Main Street, Goshen New York 10924.

The judge struck out all provisions for a temporary restraining order. In order words, paragraphs 1-6 after the word ORDERED in my Order to Show Cause were struck out.

It also orders me to serve the papers on the defendants on or before November 22, 2004.

In effect, the judge ruled that I have set forth sufficient grounds in my petition as to require the respondents to appear for a hearing in this matter.

I had expected that the judge would strike out my TRO. Judges almost always do that nowadays, in light of US Supreme Court decisions, but I had to try anyway.

I have filed suit against the United States Chess Federation and five of its board members to stop the sale of the building and the move to Crossville, Tennessee. The title of the case is Sloan vs. Marinello. It is pending in Goshen, Orange County, New York. The judge is Hon. Lawrence Ivan Horowitz. It has two index numbers: 2004-7635 and 2004-7739 .
