ORDER TO SHOW CAUSE WHY DESIGNATING PETITIONS SHOULD NOT BE DECLARED VALID

Upon the annexed petition of Samuel H. Sloan duly verified the 9th day of August 2004 and upon the original designating petitions and upon all of the papers and proceedings had herein, it is hereby
ORDERED, that the respondents show cause before this Court at a Special Term Part I thereof to be held at the County Courthouse in the Borough of Brooklyn at 360 Adams Street, Brooklyn, New York in Room ____ on the ____ day of August, 2004 at _____ AM of that day or as soon thereafter as counsel can be heard why an order should not be made and entered herein:
1. Declaring valid, proper and legally effective the designating petitions heretofore filed in the office of the Board of Elections of the City of New York designating the petitioner herein, Samuel H. Sloan, as a candidate in the Republican Primary to be held on September 14, 2004 for election to the Office of Congressman in the United States Congress representing the 10th Congressional District of Brooklyn New York; and
2. Directing, requiring and commanding the Board of Elections in the City of New York to place and print the name of the petitioner herein on the ballot as a candidate for election to the United States Congress from the Tenth Congressional District in the Republican Primary to be held on September 14, 2004; and
3. Enjoining and restraining the said Board of Elections in the City of New York from printing, issuing or distributing for use during said Primary Election in the Tenth Congressional District any official ballot upon which the name of the petitioner does not appear as a candidate for election to the United States Congress.
AND why petitioner should not have such other and further relief as to this court may seem just and proper in the premises;
Sufficient Cause appearing therefore, it is further
ORDERED, that Service of a Copy of this Order to Show Cause, together with a copy of the papers upon which it is granted on the respondents constituting the Board of Elections of the City of New York by leaving a copy thereof at the Office of the Chief Clerk of the King's County Board of Elections at 345 Adams Street, Brooklyn, New York and at the New York City Board of Elections at 32 Broadway, 7th Floor, New York NY on or before the ____ day of August 2004 and that personal service of the Order to Show Cause together with a copy of the papers upon which it is granted upon the individual respondents-objectors BIBI S. KHAN, THEODORE ALATSAS, KHOURSHED CHOWDHURY, DIANE HASLETT RUDIANO, GLADYS PEMBERTON, AARON MASLOW, LORI MASLOW, HY SINGER, HARVEY R. CLARKE and KING'S COUNTY REPUBLICAN PARTY designated as objectors be dispensed with, and that service of a copy of this order upon said respondent-objectors be made by enclosing the same in a securely sealed and duly postpaid wrapper addressed and mailed to each of the said respondent-objectors on or before the _____ day of August, 2004 be deemed good and sufficient service thereof.
