Glen Petersen, being duly sworn, deposes and says:

1. I have worked for the United States of America Chess Federation ("USCF") since 1989. I was hired in 1989 as an Assistant Director. My duties as Assistant Director varied, including being the FIDE (World Chess Federation) point of contact, and working on national tournament bids. In 1991, I became the Editor of Chess Life Magazine, which I held until the year 2000, at which time my employment with USCF ceased. In August 2003, I was hired again by USCF as a Publications Consultant, and my duties consisted primarily of timely production of Chess Life Magazine, managing print projects, including coordinating the bidding process of print jobs, i.e. brochures, stationary, business cards, posters; and I also worked as an Assistant Editor. In December 2004, T became Editor of Chess Life Magazine.

2. USCF publishes ChessLife Magazine every month. As with any other regular publication, we have strict deadlines we must meet in order to go to press on time. The deadline for publication of a USCF candidate?fs statement in Chess Life Magazine for 2005 was February 10, 2005 for the April issue, March 10, 2005 for the May issue, and April 10, 2005 for the upcoming June issue. I met Mr. Sloan at the US Amateur Team East tournament on February 21, 2005, eleven days past the deadline for the April issue of Chess Life in which Mr. Sloan wished to have his statement published. Mr. Sloan conformed that he had not yet submitted his statement. I told Mr. Sloan that if I had his statement in my hands before the weekend was up, I could possibly get it typeset and into the April issue. After consulting with a several members regarding the untimely receipt of Mr. Sloan's candidacy statement, including Dr. LeRoy Dubeck and Ms. Bea Marinello, they voiced concern that it would be unfair to the other candidates to accept Mr. Sloan's untimely submittal past the deadline for the April 2005 issue. I then consulted with the Secretary Don Schulz, who agreed. Thus, Mr. Sloan's statement was not published in the April 2005 due to its untimely submission. Mr. Sloan's statement, however, was timely for the May 2005 issue of Chess Life, and will be published in that issue.
