Timothy Hanke, being duly sworn, deposes and says:

1. I am currently a member of the Executive Board of the United States of America Chess Federation ("USCF"). I was certified as an elected member in August 2004. I also serve as vice-president of finance for USCF, an unpaid volunteer position.

2. I reside and work in the State of Massachusetts. I lived in New York State during my teenage years from 1972 to 1978. I have not resided or worked in New York State since that time.

3. I have been present in New York State on occasion relating to business on behalf of USCF, as in the attendance at the Executive Board meetings.

4. I was never served by a process server with Mr. Sloan's order to show cause, affidavit and petition from November 2004 he filed in the lower court.

5. I understand that Mr. Sloan has made allegations as to me in his current court papers. Mr. Sloan states that I have "disappeared" and may be in Iraq. I assure the Court that I have not disappeared, and I am not in Iraq. Mr. Sloan also implies that I am now an employee of USCF in violation of the By-Laws because I am also a member of the executive board, or vice-president of finance. I am not an employee. I receive no salary, wages or benefits from USCF in my service as a member of the executive board. I do however, receive partial expense reimbursement for my travel-related USCF business, which requires me to submit receipts and proof of these expenses, which are then approved by the USCF and paid upon approval.

6. There is no "conspiracy" to destroy USCF, except perhaps in Mr. Sloan's imagination. The move to Crossville was fully debated and approved by the Executive Board, most recently in October 2004. The USCF delegates voted in 2003 to relocate USCF's offices out of New York.

7. The proceeds from the sale of the real property in New Windsor were deposited into USCF's bank accounts and have been properly accounted for. To my knowledge, the LMA Committee has authorized that these proceeds be invested in certificates of deposit and money market funds for the time being.
