Petitioner Sam Sloan submitted a proposed Order to Show Cause, seeking in essence, the same relief that was the subject of this Court's January 10, 2005 Decision and Order. At that time, the Court dismissed the instant action for lack of personal jurisdiction over the Defendants.

In the instant application, the Petitioner indicates he attached an "annexed petition," to the Order to Show Cause, that together with the original papers, would justify the issuance of the new Order to Show Cause. None of those documents were submitted with the proposed Order to Show Cause.

The Court requires that the Petitioner submit a copy of the pleadings and such other evidence as the Petitioner has that indicate that the Court has personal jurisdiction in this matter. Further, the Petitioner must explain how his present submission differs from the November 16, 2004 Order to Show Cause.

This Court notes that the Plaintiff did not file a CPLR ??2221 motion, seeking leave to move that this Court reconsider its January 10,2005 Decision and Order.

Relying on the foregoing, this Court DECLINES to approve the proposed Order to Show Cause.

The foregoing constitutes the order of this Court.
